PLANNING BOARD
PROPOSED DEFINITION OF COMMERCIAL
WIND TURBINE
IN ACCORDANCE WITH ORDINANCE NO. 2024-21:
Commercial Wind Turbine: any wind turbine used to generate electricity and sell that electricity to a second party.
On-Site Wind Turbine: any wind turbine used to generate electricity which is to be used on the site of the electricity production. On-Site Wind Turbines shall NOT sell electricity to a second party. Any On-Site Wind Turbine construction MUST have a turbine be twice the distance from the property line as it is tall and MUST come before the Madison County Planning Board for approval before construction will be permitted. Permit fees for approved On-Site Wind Turbines shall be set at $1,000.00 per approved installation.
* These definitions will only apply insofar as Ordinance No. 2024-21 is in effect. After the termination of the moratorium applied in Ordinance No. 2024-21 sunsets, these definitions shall be void. The Planning Board, with Quorum Court approval, may nullify, amend, or add to these definitions sooner than the sunset of the moratorium insofar as those updates are consistent with the intent of Ordinance No. 2024-21. All lasting rules and regulations shall be drafted by the Planning Board and approved by the Quorum Court in accordance with the procedures of Ordinance No. 2025-7, and these lasting rules and regulations can operate concurrently with the definitions contained herein. *

AMENDING
ORDINANCE 2024-19 (THE 2025 BUDGET) AND APPROPRIATING MONIES FROM VARIOUS FUNDS TO THEIR RESPECTIVE DEPARTMENTS.
NOW THEREFORE, be it enacted by the Quorum Court of Madison County, State of Arkansas.
Section 1: Ordinance No. 2024-19 is hereby amended, and the sum of $48,840.85 is hereby appropriated from Fund 1000, the County General Fund, to the following departments and line items in the amounts and in the manner set forth below:
A.Fund 1000, County General, Department 0119, Other County Expenses, $37,416.00 to Line Item 3999, Other Services and Charges
B.Fund 1000, County General, Department 0110, County Planning Board, $11,424.85 to Line Item 3999, Other Services and Charges
Section 2: Under the general laws of the State of Arkansas, appropriation ordinances are enacted without separate readings upon a 2/3’s vote of the Quorum Court and shall be effective immediately.

Ordinance No. 2025-13
BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY
OF MADISON,
STATE OF ARKANSAS; AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE
PLACING A
MORATORIUM ON THE CONSTRUCTION OF COMMERCIAL GROUND MOUNTED SOLAR
INSTALLATIONS AND TO DECLARE AN
EMERGENCY
WHEREAS, the Quorum Court of Madison County, State of Arkansas, finds it in the best interest of the County to give time to its recently established Planning Board to investigate the nature of commercial ground mounted solar installations and the costs and benefits of any such project for the County of Madison and its citizens in order to draft the most adequate rules and regulations. The definition of what constitutes a “commercial ground mounted solar installation” shall be considered any ground installed solar power generation operation over 0.5 acres in size, and;
WHEREAS, A.C.A. § 14-14-802 and A.C.A. § 14-14-804 give county governments broad authority on providing services and the power to exercise regulatory powers in conjunction with those services, including the service of planning and zoning control, and;
WHEREAS, a moratorium gives the Madison County Planning Board time to consider its duty in A.C.A. § 14-17-205 “to prepare or have prepared plans for the county, to receive and make recommendations on public and private proposals for development, to prepare and transmit to the county quorum court recommended ordinances implementing plans, and to advise and counsel the county judge, the court, and other public bodies on planning-related matters”, and;
WHEREAS, a moratorium is within the authority of the both the Madison County Quorum Court and the Madison County Planning Board in the development of the County Plan under A.C.A. § 14-17-206, which directs the development of the plan to “best promote the health, safety, convenience, prosperity, and welfare of the people of the county”.
NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF MADISON COUNTY, ARKANSAS:
A MORITORIUM ON THE CONSTRUCTION OF COMMERCIAL GROUND MOUNTED SOLAR INSTALLATIONS
1) Beginning May 28, 2025 and ending August 31, 2025, there is a moratorium placed on the construction of commercial ground mounted solar installations in the County of Madison, State of Arkansas.
2) This moratorium shall be put in place to give the Madison County Planning Board the requisite time to develop plans around the construction of commercial solar installations in Madison County.
3) This moratorium shall not apply to the construction and/or maintenance of commercial ground mounted solar installations that are a) already in existence, b) have begun construction, or c) have contracted to build and created plans for the construction of commercial ground mounted solar installations prior to May 28, 2025 when this Moratorium takes effect.
4) The above-mentioned dates in section 1) shall not be construed to be a limit nor an allowance on the construction of commercial ground mounted solar installations prior to, or following the dates in question. All enduring rules and regulations shall be drafted by the Planning Board and affirmed by the Quorum Court, given time for drafting and consideration.
5) The Quorum Court finds that the immediate implementation of this ordinance is necessary for the preservation of the public’s peace, health, safety, welfare, and property, an emergency is hereby declared to exist and that this Ordinance is to be in effect immediately after its adoption.
